What WillCreator is
WillCreator is a document-preparation service. It assembles a last will and testament from the instructions you provide through our questionnaire. It is designed for straightforward South African estates.
WillCreator is not a law firm and does not provide legal, tax or financial advice. Using this service does not create an attorney–client relationship.
Your responsibilities
The accuracy of your will depends on the accuracy of your answers. Review the full document carefully before finalising it.
A will is only valid once it is printed and signed strictly in accordance with the Wills Act 7 of 1953. Follow the signing guide included with your document. WillCreator cannot verify that you signed your will correctly.
If your estate involves trusts, business interests, foreign assets, or the possibility of maintenance claims by dependants, consult a fiduciary professional or attorney instead of using this service.
Executor nomination
You choose your own executor. If you nominate our professional executor service, that nomination only takes effect at death, is subject to appointment by the Master of the High Court, and any remuneration is charged to the estate at or below the tariff prescribed by law. There is no obligation to nominate us, and your will is not priced differently based on your choice.
Privacy
We process your personal information solely to prepare your will and operate your account, in line with the Protection of Personal Information Act (POPIA). Your answers and documents are stored encrypted and are never sold or shared with third parties, except as required to provide the service (e.g. emailing your document to you) or by law.
You may delete a will — and the personal information inside it — from your dashboard at any time.
Liability
While we take great care to keep our templates correct and current, WillCreator is provided “as is” during its beta period. To the maximum extent permitted by law, including the Consumer Protection Act, our liability is limited to the amount you paid for the service.
